2. Products and Product Descriptions

We make reasonable efforts to ensure that product descriptions, photographs, specifications, dimensions, colors, materials, and pricing displayed on our website are accurate.

However, actual products may vary slightly from website images or displayed descriptions due to manufacturing processes, natural material variations, lighting, screen settings, or product updates.

Customers are responsible for reviewing product specifications, dimensions, features, and compatibility before placing an order. Please contact us with any questions about a product before purchasing.

We reserve the right to correct errors, update product information, and discontinue products where permitted by applicable law. Changes will not eliminate rights already established under a confirmed purchase agreement or applicable law.

3. Pricing and Payment

All prices are subject to change before an order is confirmed. The price applicable to a purchase will be the price stated in the accepted quote, invoice, or order confirmation, subject to any clearly disclosed conditions.

Unless otherwise stated, prices may not include applicable sales taxes, delivery charges, installation fees, permits, site preparation, or additional services.

Payment terms, deposits, installment arrangements, and any remaining balances will be communicated during the ordering process. Customers agree to pay the amounts specified in their accepted order or invoice.

An order may not be processed, scheduled, or released for delivery until required payments have been received and any applicable payment conditions have been satisfied.

4. Orders and Order Confirmation

All orders are subject to acceptance by K.C. Shepherd LLC.

Submitting an inquiry, requesting a quote, or adding a product to a shopping cart does not necessarily constitute an accepted order. An order is considered confirmed when we provide written confirmation or otherwise expressly accept the order.

Customers are responsible for verifying that order confirmations accurately reflect the selected products, quantities, options, delivery address, and other relevant details.

Please notify us promptly if you identify an error in your order. Changes may not be possible once an order has entered production, procurement, preparation, or shipment.

5. Shipping, Delivery, and Scheduling

Delivery estimates are provided in good faith but are not guaranteed unless expressly agreed to in writing.

Delivery dates may be affected by manufacturer availability, transportation delays, weather, supply-chain disruptions, carrier scheduling, or other circumstances beyond our reasonable control.

Customers are responsible for providing accurate delivery information and ensuring that the delivery location is reasonably accessible for the intended shipment.

Depending on the product and delivery arrangement, customers may need to arrange for unloading equipment, sufficient access, or additional labor. Any such requirements and associated charges will be communicated where applicable.

Delivery charges, delivery limitations, and any special handling requirements will be disclosed before the order is finalized.

Customers should inspect delivered products as soon as reasonably possible and promptly report visible shipping damage, missing components, or incorrect items. Reporting procedures do not limit any rights customers may have under applicable law.

6. Installation and Site Preparation

Some products sold by K.C. Shepherd LLC may require assembly, site preparation, foundation work, electrical connections, plumbing, ventilation, drainage, or other installation services.

Unless expressly included in a written quote or order confirmation, installation and site preparation are not included in the purchase price.

Customers are responsible for ensuring that the installation site is suitable for the selected product, including adequate dimensions, structural support, drainage, ventilation, access, and applicable utility connections.

Customers must obtain any required permits, inspections, approvals, or property-owner permissions unless a written agreement expressly assigns those responsibilities to K.C. Shepherd LLC.

Electrical, gas, plumbing, structural, and other regulated work must be performed by appropriately qualified professionals where required by law.

We are not responsible for delays or additional costs arising from unsuitable site conditions, inaccessible installation locations, undisclosed obstacles, or work performed by independent contractors, except to the extent caused by our own acts or omissions or otherwise required by law.

7. Sauna-Specific Terms

Indoor and outdoor saunas must be installed, operated, maintained, and used in accordance with the manufacturer's instructions and applicable safety requirements.

Customers are responsible for verifying that their intended installation location is appropriate for the selected sauna, including any required ventilation, moisture protection, electrical capacity, clearances, and structural support.

Saunas may involve high temperatures, electrical components, heating equipment, and moisture exposure. Customers should follow all manufacturer safety instructions and consult qualified professionals when necessary.

Saunas should be used responsibly and should not be operated contrary to manufacturer guidelines. Children must be supervised as appropriate, and individuals with medical concerns should consult a qualified healthcare professional before sauna use.

K.C. Shepherd LLC does not provide medical advice or guarantee any particular health or wellness outcome from sauna use.

8. Gazebo-Specific Terms

Gazebos must be installed on an appropriate surface or foundation and secured in accordance with manufacturer specifications and applicable local requirements.

Customers are responsible for assessing site conditions, drainage, ground stability, overhead obstructions, and any required permits or approvals.

Gazebos may be affected by high winds, heavy rain, snow, falling debris, and other environmental conditions. Customers must follow manufacturer guidance regarding anchoring, weather precautions, seasonal preparation, and maintenance.

Unless expressly stated in writing, gazebos are not guaranteed to withstand every weather event or environmental condition.

9. Outdoor Kitchen-Specific Terms

Outdoor kitchens may include cabinetry, countertops, grills, appliances, electrical components, plumbing fixtures, gas connections, and other equipment.

Customers are responsible for ensuring that products are suitable for their intended environment and are installed with appropriate weather protection, clearances, ventilation, utility connections, and safety measures.

Gas, electrical, and plumbing installations must comply with applicable codes and be performed by qualified professionals where required.

Outdoor appliances and materials must be maintained according to manufacturer instructions. Exposure to weather, moisture, extreme temperatures, grease, and environmental contaminants may affect appearance, performance, and service life.

Unless specifically included in a written agreement, utility connections, construction, permits, and installation labor are not included in the product purchase price.

10. Cancellations, Returns, and Exchanges

Customers who wish to cancel or change an order should contact K.C. Shepherd LLC as soon as possible.

Cancellation eligibility, restocking charges, return shipping costs, and refund amounts may depend on the product, order status, supplier requirements, and the terms disclosed at the time of purchase.

Custom-made, personalized, special-order, or made-to-order products may be subject to additional cancellation or return restrictions where permitted by law.

No cancellation, return, or refund restriction will override a customer's non-waivable rights under applicable law.

Customers must obtain return authorization before shipping a product back. Unauthorized returns may be delayed or refused where permitted by law.

Approved refunds will be processed using the original payment method where reasonably practicable and in accordance with applicable payment-processing requirements.

Customers are responsible for following the manufacturer's recommendations for cleaning, inspection, maintenance, storage, and general care.

Failure to follow care instructions may affect product performance, appearance, longevity, or eligibility for certain warranty claims.

Natural wear, improper maintenance, unauthorized modifications, misuse, and damage caused by environmental exposure may not be covered by applicable manufacturer warranties, subject to the specific warranty terms and applicable law.

13. Limitation of Liability

To the fullest extent permitted by applicable law, K.C. Shepherd LLC will not be liable for indirect, incidental, special, or consequential damages arising from the use of our website, products, or services, except where such liability cannot legally be excluded or limited.

Nothing in these Terms and Conditions excludes or limits liability for fraud, intentional misconduct, gross negligence where such limitation is prohibited, or any other liability that cannot lawfully be excluded or limited.

Customers are responsible for using products safely, following manufacturer instructions, and ensuring that installation and operation comply with applicable requirements.
